On Monday, Harold Montague will be arraigned in Clark County District Court for the murder of Damian Castro. Montague killed the child in an apparently random act of violence. His defense attorney has already said that he will plead not guilty by reason of insanity. The defense claims that Montague is "delusional." Meanwhile the District Attorney's office is contemplating seeking the death penalty. The insanity defense has been controversial in Nevada in recent years and we look at the state of the law with UNLV Boyd Law School Professor Christopher Blakesley.
