Nevada Attorney General Catherine Cortez Masto recently joined Arizona in suing the Bank of America to change its foreclosure practices. So what difference can the lawsuit make in the foreclosure crisis. The Attorney General will be here to discuss the mortgage problems as well as other issues such as foreclosure scams and Medicaid fraud.
We also have MERS on our title and deed. We don't know who really is the owner of our note. We would also like to find this out and see if in fact BofA owns our note (wet ink signature original) if they don't really own it then we would like some help in finding out who owns it. BofA told us they own it but so far no proof. MERS is still on our title and deed loan docs. We are worried that when and if we ever pay off our home that we will never own it because BofA won't be able to come up with the note to give to us. We are worried that when that time comes someone else will come to us and say you owe us x amount of money for this home and you've paid all that money to the wrong entity. BofA also denied us with HAMP. (Recently, this past week, we received a FEDEX package from BofA stating we may qualify for a HAMP with BofA. In the kit was paperwork for us to fill out and some of it was already partially filled out by BofA. The kit stated that we had to return the filled out package to BofA by 2/2011 in the prepaid FEDEX envelope. It also stated that this was part of a collection agency. The next day we received a phone call from BofA stating they received our FEDEX package and that there was missing paperwork that we needed to send to them. And we can call their 1-800 number and talk with anyone of their representatives. The funny thing is, we never sent in that package. The next day we received another phone call from BofA regarding HAMP. My husband told BofA that we were denied by BofA for Hamp a long time ago. The representative said so you want to be put on the do not call list then? Seems to us that BofA does not know what they are doing. One department does not know what the other department is doing, who was offered what or who was denied what. The have no idea what is in a clients file either.

We need some help keeping pur home servicer Bank of America. Received many e-mails from attorneys and want to know if they are ligit? We have lost money at another loan modafaction company. Do not know who to trust seems they all want money up front.

We have had many dealings with BofA with home loan mod issues. They told us we had to be in default in order to get their attention, then they told us we had to come up with the lump sum that we were behind and become current in order to receive their "wonderful offer" and then they would not tell us what the offer was until we paid that lump sum. Reasons given to us were various forms of denials. From flat out denial with no explanation, to you're not behind in payments so we can not help you denial, to you have no hardship, which we did prove
they reported neg on both our credit rpts during the time we were trying to obtain loan modification. they finally did tell the credit reporting agencies to remove the bad reporting by them after calls and letters to BofA from us, after we got our loan mod.

continued....by fed ex and that we had 48 hours to sign and notarize it with their notary of choice and send back to them. giving us no time to review the paperwork with an attorney and no information of the loan mod until we received paperwork and no one to explain the terms of the modification and how that would help us.
Bank of America also denied us for principal reduction even though it says on their website that principal reductions are available and there are many options available for Countrywide loans.. They told us in no way would we qualify for a principal reduction ever. Like most Nevadans, we are upside down in our home. We owe 265,000 and our home is worth 110,000.

We were able to retructure our loan a few years ago. But the
Bank would not take away part of our principle. How can we reduce our principle now? Can we remodify again?Rob –Jan 27, 2011 10:42:53 AM
My home was foreclosed, but before that happened the lender sold my 2nd mortgage to a collection agency. They are now hounding me for that debt. Do I have any options to fight this? Michael Northrup –Jan 27, 2011 10:22:22 AM
